The High Court on Sunday stayed an order that had declared the nomination of BNP rebel candidate Mobaswer Alam Bhuiyan invalid.
The ruling clears the way for him to contest the 13th national parliamentary election in the Comilla-10 constituency, comprising Nangalkot and Lalmai.
As a result of the order, there are no legal obstacles at present to Bhuiyan’s candidacy in the polls.
The order was passed by a High Court bench of Justice Razik-Al-Jalil and Justice Md Anowarul Islam after hearing a writ petition filed by the candidate.
Barrister M Jamiruddin Sircar represented Mobaswer Alam Bhuiyan, while lawyer Mizanur Rahman appeared on behalf of the Election Commission.
Bhuiyan moved the High Court challenging the Election Commission’s decision to reject his candidacy.
Earlier, his nomination paper for the Comilla-10 seat was cancelled during scrutiny at the district level over allegations that he was a loan defaulter.
He later appealed the Returning Officer’s decision to the Election Commission, but the appeal was rejected, prompting him to seek legal remedy from the High Court.
