The Appellate Division has dismissed a leave-to-appeal petition challenging the High Court order that upheld the candidacy of BNP candidate Kazi Shah Mofazzal Hossain Kaikobad in Cumilla-3.
Following the order issued on Tuesday, there is no legal bar for Kaikobad to take part in the 13th parliamentary election on 12 February, his lawyers said.
Ruhul Quddus Kajal and Mahbubur Rahman Khan represented Kaikobad, while Mohammad Hossain Lipu appeared for Jamaat-e-Islami candidate Md Yusuf Sohel.
Sohel appealed to the Election Commission seeking cancellation of Kaikobad’s nomination over allegations of dual citizenship. When the EC upheld his candidacy, Sohel filed a writ petition, which was later dismissed by the High Court.
