The Election Commission (EC) has filed a petition with the Appellate Division challenging a High Court verdict that declared illegal the EC’s gazette altering the boundary of the Comilla‑2 constituency.
The chamber judge’s court of the Appellate Division is set to hear the petition on Sunday, according to court sources.
Earlier, on 8 January, the High Court (HC) declared illegal the EC’s gazette changing the boundary of Cumilla‑2 and ordered that the previous boundary be restored and a fresh gazette be issued within 24 hours.
On 24 September last year, the HC had issued a rule asking why the changes made to the boundary of Cumilla‑2 should not be declared illegal. The rule was issued by an HC bench comprising Justice Md Mozibur Rahman Miah and Justice Bishwajit Debnath.
Prior to that, a writ petition was filed by Nazim Uddin Alam, the Jamaat‑e‑Islami‑nominated candidate for the constituency, challenging the legality of the boundary re‑demarcation.
According to lawyers, the original Cumilla‑2 constituency consisted of Meghna and Titas upazilas.
Under the revised demarcation, Homna was added to Cumilla‑2 and Meghna was shifted to Cumilla‑1, making Cumilla‑2 comprise Homna and Titas.
