The Appellate Division has adjourned the hearing on the appeals filed against the High Court verdict that scrapped parts of the 15th Amendment to the Constitution.
The final hearing on the appeals against the High Court verdict regarding the 15th amendment will be held after the 13th national election.
The six-member bench of the Appellate Division of the Supreme Court led by Chief Justice Syed Refaat Ahmed passed the order after holding a hearing on the matter on Thursday.
The court adjourned the next hearing to 5 March. At that time, the chief justice said, “We have cleared 15 years of backlog in 16 months.”
The High Court delivered its judgement on 17 December last year scrapping a part of the 15th amendment to the constitution that abolished the non-partisan caretaker government system. After hearing two separate writ petitions, the court pronounced several sections of the 15th Amendment unconstitutional and void.
The Awami League government introduced the amendment by abolishing the caretaker government system and bringing major changes to the Constitution. The parliament passed the amendment on 30 June 2011, revising 54 provisions.
Following the July mass uprising, two writ petitions were filed at the High Court challenging the legality of the entire amendment and several of its sections.
