The hearing of the appeal against the High Court verdict, which annulled parts of the 15th Amendment to the Constitution including abolition of the caretaker government system, will be held on Thursday.
A six-member bench of the Appellate Division led by Chief Justice Syed Refaat Ahmed set the date for the hearing on Wednesday.
Earlier, BNP Secretary General Mirza Fakhrul Islam Alamgir applied to be made a party to the appeal, and the court later granted his application. On behalf of the BNP leader, Barrister Ruhul Quddus presented arguments in court.
After the final hearings of two separate writ petitions, the High Court declared parts of the 15th Amendment unconstitutional and annulled them on 17 December last year. Against this verdict, four individuals, including the secretary of Shushashoner Jonno Nagorik (SHUJAN), filed an appeal. Additionally, appeals were filed on behalf of Naogaon resident Md Mofazzal Hossain and Jamaat-e-Islami.
The Awami League government had introduced the 15th Amendment to the Constitution, which included the abolition of the caretaker government system. The 15th Amendment Act was passed in the Jatiya Sangsad on 30 June 2011.
The amendment brought changes to 54 provisions of the Constitution, including the abolition of the caretaker government.
Following the July mass uprising, two separate writ petitions were filed in the High Court last year challenging the legality of the entire 15th Amendment law and some of its sections. After the hearings, the High Court delivered its verdict on 17 December last year.
