Police have filed an application to show former chief justice ABM Khairul Haque as arrested in a murder case filed with Jatrabari Police Station.
Sub-Inspector Md Ibrahim Khalil of Jatrabari Police Station submitted the application on 16 May.
A hearing on the matter is scheduled to be held on Saturday at the court of Dhaka Metropolitan Magistrate Sarah Farzana Haque in the afternoon.
Sub-Inspector Moin Uddin of the police prosecution branch confirmed the development.
Court sources said Khairul Haque was produced before the court around 11:20am in a wheelchair. He was seen speaking with his lawyers before being taken back to the CMM court lock-up at around 11:49 am. He is expected to be brought before the court again for the scheduled hearing later in the day.
The application states that Khairul Haque is an accused in the case and is currently in jail custody. Investigators have reportedly found preliminary evidence of his involvement in the incident. Police argued that showing him arrested in the case is necessary for the sake of a fair and proper investigation.
According to the case statement, the incident occurred on the morning of 5 August, 2024, during a student-led anti-discrimination movement. Victim Khobayb, 20, was taking part in a peaceful gathering under Jatrabari flyover when police, members of RAB, and armed activists of affiliated organisations allegedly opened fire on protesters, killing him on the spot.
The victim’s brother, Zobayer Ahmed, filed the case on 16 November, 2024, naming 80 accused, including former prime minister Sheikh Hasina, Sheikh Rehana, and Obaidul Quader.
Meanwhile, the High Court had earlier directed that Khairul Haque should not be shown arrested or harassed without specific cases against him.
A bench comprising Justice Razik-Al-Jalil and Justice Debashish Roy Chowdhury issued the order last Sunday and also issued a rule in this regard.
