The state has filed a petition with the Appellate Division seeking a stay on the High Court order that granted bail to former chief justice ABM Khairul Haque in two murder cases related to the July mass uprising.
The application was submitted to the relevant branch of the Appellate Division of the Supreme Court on Wednesday.
This legal move comes after the High Court granted bail to the former chief justice on 12 May in two specific murder cases.
Following that order, his lawyers had stated that there were no further legal impediments to his release from prison, as he had secured bail in all pending cases.
However, the state subsequently moved to challenge that bail order in the apex court.
Justice Khairul Haque had approached the High Court after being denied bail by the lower courts in cases involving the murders of Arif at Jatrabari Police Station and Rubel at Adabor Police Station.
The former chief justice has been facing a series of legal challenges.
On 28 April, the Appellate Division upheld his bail in five other cases, which included the murder of a Jubo Dal activist, allegations of forging the verdict regarding the caretaker government system, and cases filed by the Anti-Corruption Commission (ACC).
Records show that on 8 March, the High Court granted him bail in four cases following the conclusion of rule hearings, and he secured bail in another ACC case on 11 March. Although the state had previously applied to the Appellate Division to stay those bail orders, their petitions were dismissed.
Justice Khairul Haque was arrested on 24 July last year from his residence in Dhanmondi, Dhaka. He was initially shown arrested in a case involving the murder of Jubo Dal activist Abdul Kaiyum Ahad in Jatrabari, an incident cited as occurring during the July mass uprising
