The High Court has declared valid the nomination of BNP candidate Sarowar Alamgir for Chattogram‑2 constituency in the 13th Parliamentary Election.
A High Court bench comprising Justice Fahmida Quader and Justice Md Ashif Hasan delivered the verdict on Thursday.
Following the judgement, his lawyer AM Mahbub Uddin Khokon said there is no longer any bar to gazette notification and oath‑taking.
Earlier, on 2 July, after completion of a rule hearing, the court fixed 9 July (Thursday) for pronouncement of judgment.
Lawyers Ahsanul Karim and Barrister AM Mahbub Uddin Khokon represented the writ petitioner in court, while Jamaat-e-Islami candidate Nurul Amin was represented by lawyers Shishir Monir and Azim Uddin Patwari.
After Sarowar Alamgir’s nomination was initially accepted by the returning officer, Jamaat candidate Md Nurul Amin filed an appeal alleging loan default.
Following hearing, the Election Commission cancelled his candidacy on 18 January. Alamgir then filed a writ petition with the High Court challenging the cancellation.
On 27 January, the High Court stayed the Election Commission’s order cancelling Alamgir’s candidacy, issued a rule, and directed that he be allowed to contest the election.
Nurul Amin later filed a leave‑to‑appeal petition with the Appellate Division against the High Court order.
On 3 February, the Appellate Division granted a leave to appeal against continuation of Alamgir’s candidacy. As a result, Alamgir was allowed to contest the election, but the result was to remain withheld until disposal of the appeal.
In the 12 February election, the BNP candidate won, but the result was not published due to the court’s order.
Later, after hearing on Nurul Amin’s appeal, the Appellate Division issued an order on 16 June. In disposing of the appeal, the Appellate Division directed the High Court to settle the rule expeditiously, preferably within two weeks.
It also stated that until the rule is disposed of, the 3 February order of the Appellate Division would remain in force.
