The Cabinet has given final approval to the draft “Public Procurement (Amendment) Ordinance, 2026” to modernise provisions for alternative procurement arrangements during state emergency requirements.
The decision was taken at a Cabinet meeting chaired by the Prime Minister Tarique Rahman on Sunday, according to a press release.
“The draft ‘Public Procurement (Amendment) Ordinance, 2026’ has been presented to the Cabinet for the purpose of modernising alternative procurement arrangements and related provisions for state emergency requirements,” the press release stated.
Through the amendment of the public procurement law, provisions have been set out to protect the interests of domestic industries, generate greater competition in procurement, and expand rules regarding procurement contract management and administration.
Additionally, the draft modernises open tendering procedures and applies limited tendering methods aimed at achieving the equitable distribution of resources.
To strengthen sustainable procurement systems, it introduces ratio-based criteria evaluation for goods, works, and physical services, which is synonymous with the internationally widely practised ‘Rated Criteria’ concept. Clear provisions regarding professional misconduct have also been incorporated into the draft.
The press release added that the draft ordinance was granted final approval in the Cabinet meeting subject to vetting by the Legislative and Parliamentary Affairs Division.
