The Appellate Division of Supreme Court has stayed a High Court order which stipulated that betel leaf cannot be exported from Bangladesh without a certificate from Bangladesh Betel Leaf Exporters Association.
On Sunday, the court of Chamber Judge Justice Md Rezaul Haque of the Appellate Division passed this order. Consequently, there is no longer any legal impediment to exporting betel leaf, said Attorney General Md Ruhul Quddus.
Following an application by Bangladesh Betel Leaf Exporters Association, a bench of the High Court Division had issued an order on 6 August mentioning that betel leaf cannot be exported from Bangladesh without a certificate from the said association.
As a result, the requirement to obtain a certificate from the association became compulsorily effective for betel leaf exports.
Challenging the effectiveness of that order, Trade Organisation wing on behalf of the Ministry of Commerce filed an application with the Appellate Division of Supreme Court.
Following the hearing on the application, the Chamber Court stayed the operation of the High Court’s 6 August order.
As a result, the condition imposed through the High Court order requiring a certificate from Bangladesh Betel Leaf Exporters Association for betel leaf export will remain stayed.
In court, Attorney General Barrister Md Ruhul Quddus Kazal represented the Ministry of Commerce.
He was assisted on behalf of the ministry by lawyer Md Tajul Islam. On the other hand, lawyers Fida M Kamal and Faisal Mohammad Fayezi were present on behalf of the Bangladesh Betel Leaf Exporters Association.
