The Supreme Court’s Appellate Division will issue its order on Thursday regarding BNP candidate Sarwar Alamgir’s application seeking the declaration of election results and opportunity to take oath from the Chattogram-2 (Fatikchhari) constituency.
The bench, led by Chief Justice Zubayer Rahman Chowdhury, passed the order on Wednesday, following a partial hearing of the application.
Case background
The High Court had earlier stayed the Election Commission’s order canceling Sarwar Alamgir’s candidacy over allegations of loan default, directing that he be allowed to contest the election.
Jamaat candidate Nurul Amin subsequently filed a leave to appeal with the Appellate Division against the High Court order.
On 3 February, the Appellate Division granted the leave to appeal against the reinstatement of Sarwar Alamgir’s candidacy. While this allowed him to contest the election, the court ordered that the results for the seat would remain stayed until the appeal was disposed of, and no results would be published.
The election for the constituency was held on 12 February. Sarwar Alamgir was unofficially declared victorious, but due to the court order, the results have yet to be officially declared.
In this situation, Alamgir filed an application seeking the opportunity for result declaration and oath-taking.
Jamaat candidate’s lawyer Shishir Monir said a partial hearing was held on Wednesday.
“An order will be issued on the application tomorrow. In the application, Sarwar Alamgir has sought the opportunity for result publication and oath-taking. During the hearing, we said that if such an application is accepted without a hearing on the main appeal, the necessity of the main appeal will cease to exist,” he said.
