The High Court on Sunday directed authorities not to arrest or harass former chief justice ABM Khairul Haque without a specific case filed against him.
A High Court bench comprising Justice Razik-Al-Jalil and Justice Debasish Roy Chowdhury issued the order alongside a rule in the matter.
Advocates Kamrul Haque Siddiqui, Sayeed Ahmed Raja, Mustafizur Rahman, and Monaem Nabi Shahin appeared for the petitioner during the hearing.
Earlier, on 12 May, the High Court granted bail to Khairul Haque in two murder cases filed over incidents related to the July mass uprising.
Following the order, his lawyers stated that there was no legal obstacle to his release from prison, as he had secured bail in all pending cases against him at that time.
However, the state later moved the Appellate Division seeking a stay on the High Court order.
Earlier, on 28 April, the Appellate Division upheld his bail in five cases, including allegations related to the killing of a Jubo Dal activist during the July uprising, alleged forgery of the caretaker government verdict, and three cases filed by the Anti-Corruption Commission (ACC).
Previously, on 8 March, the High Court granted him bail in four cases after issuing a rule. He later obtained bail in an ACC case on 11 March.
The state sought to stay that bail order as well, but the Appellate Division rejected the plea.
Subsequently, Khairul Haque was shown arrested in the Arif murder case filed with Jatrabari Police Station and the Rubel murder case filed with Adabor Police Station. After lower courts rejected his bail petitions in those cases, he appealed to the High Court, which granted him bail on 12 May.
Court sources said a total of seven cases are currently pending against the former chief justice. Khairul Haque was arrested from his Dhanmondi residence on 24 July last year.
He was later shown arrested in the murder case of Jubo Dal activist Abdul Kaiyum Ahad, filed over violence during the July mass uprising in Jatrabari.
