An order on the framing of charges against 26 accused, including former local Member of Parliament (MP) Habib Hasan, in a crimes against humanity case over the murder of Mir Mahfuzur Rahman Mugdho and several others in the capital’s Uttara during the July Mass Uprising, will be delivered on Wednesday.
On 16 September, International Crimes Tribunal-2 (ICT-2) fixed the date for delivering the order regarding the charge framing.
Prosecutor Gazi MH Tamim argued on behalf of the prosecution in the case, while Advocate M Liton Ahmed represented the defence. State-appointed lawyers Advocate Md Amir Hossain and M Hasan Imam appeared for the absconding accused.
Charges of crimes against humanity have been brought in this case over the killing of 11 people, including Mir Mahfuzur Rahman Mugdho, in Uttara during the July Mass Uprising.
The eight accused currently arrested and in prison in connection with the case are former Additional Deputy Commissioner (ADC) of DMP Uttara Division Mirza Salahuddin, former Officer-in-Charge (OC) of Uttara East Police Station Md Muzibor Rahman, former Constable of Azampur Police Outpost Md Hossain Ali, President of Uttara West Thana Awami League Monowar Islam Chowdhury Robin, Jubo League President Md Delwar Hossain Rubel, Awami League leader Md Sohel Rana, Vice-President of Ward Sechhabak League Md Shah Alam, and Awami League activist of Turag Thana area Md Irfanul Haque Gazi.
The remaining 18 accused in the case are absconding. They are former MP for Dhaka-18 constituency Mohammad Habib Hasan, former DMP Commissioner Habibur Rahman, former Deputy Commissioner (DC) of DMP Uttara Division Kazi Ashraful Azim, former Additional Deputy Commissioner (ADC) Md Tohidul Islam, former Assistant Commissioner (AC) Suman Kar, former OC of Uttara West Police Station BM Forman Ali, former Police Inspector (Operations) of Uttara East Police Station Mahmudul Hasan, former Constable Md Abu Sayem, former Sub-Inspector (SI) Khaled Anwar, and former Assistant Sub-Inspector (ASI) Md Roknuzzaman.
Besides, the absconding accused include former Dhaka North City Corporation (DNCC) Councillor Jahangir Hossain, former Councillor Md Farid Ahmed, former Councillor DM Shamim, former Councillor Md Anisur Rahman Naiem, former Councillor Md Afsar Uddin Khan, Awami League leader Md Alauddin Al Sohel, former Vice-President of Uttara West Thana Chhatra League Murtafa Bin Omar, and Jubo League leader of Turag Thana Awami League Zakir Hossain.
The prosecution said in the charge sheet that 11 people, including Mugdho, were shot dead in Uttara on 18 and 19 July.
Prosecutor Tamim informed that details regarding the killings that took place on 18 and 19 July on Dhaka-Mymensingh highway in Uttara and surrounding areas have been presented. Two separate charges have been brought in this case.
Under the first charge, on 18 July 2024, Mir Mahfuzur Rahman Mugdho, a student of Bangladesh University of Professionals (BUP), was assisting in taking those injured in the July Revolution to hospital for treatment at Sector 3, Uttara, while distributing water and biscuits to the student-masses.
At that time, he was shot. Several members of the student-masses took him to Uttara Crescent Hospital, where doctors declared him dead.
On the same day, Zahiduzzaman Tanvin, Sheikh Fahmin Zafar, Md Shakil Hossain, Md Sabbir Hossain, and Sojib Sarkar were shot dead in the Uttara area.
Additionally, Uber driver Mokhlesur Rahman Durjoy was killed in Uttara that day after being crushed under the rear wheel of an Armoured Personnel Carrier (APC).
Under the second charge, on 19 July 2024, Ridwan Sharif, Md Sabbir Islam, Md Asadullah, and Naima Sultana were shot dead in the Uttara area.
