A writ petition has been filed with the High Court challenging the legality of the announced schedule to hold the national parliamentary election and a referendum on the same day.
The petition seeks a stay on the operation of the schedule and requests the court to issue directives for forming a caretaker government and announcing a fresh election timetable under such an arrangement.
The writ was filed on Monday by Supreme Court lawyer Md Yunus Ali Akand with the concerned branch of the High Court.
Speaking to reporters, he said the Constitution makes no provision for an interim government and, as such, no election can legally be held under such an arrangement. “Elections must be held either under a caretaker government or an elected government,” he said.
The Chief Election Commissioner and other concerned authorities have been made respondents in the petition.
The writ is likely to be placed for hearing later this week before a High Court bench comprising Justice Ahmed Sohel and Justice Fatema Anwar.
