Supreme Court lawyer Advocate Shishir Monir has sent a legal notice to two secretaries of the Law Ministry, alleging contempt of court over the move to shift the Supreme Court Secretariat to a ministry in violation of a High Court order.
The notice sent on Tuesday said the High Court directed the government to establish an independent and separate Supreme Court Secretariat within three months from the date of its judgement. As the government did not file any appeal against the verdict, the directive has become binding under the Constitution.
The notice further said that the President issued the Supreme Court Secretariat Ordinance, 2025 on 30 November 2025. The secretariat was inaugurated on the Supreme Court premises on 11 December of the same year. Necessary manpower was recruited and the secretariat became fully operational.
Referring to the passage of the Supreme Court Secretariat Abolition Act, 2026 in parliament on 10 April, the notice said the Law Ministry later took steps to transfer infrastructure and documents related to the secretariat’s operations. Through this move, the two secretaries of the Law Ministry have shown disregard for the court’s judgement.
In this context, Shishir Monir requested them to refrain from any activities related to relocating the infrastructure and documents of the Supreme Court Secretariat. Otherwise, he said a contempt of court case would be filed with the High Court.
