A complaint has been filed with the Supreme Judicial Council against High Court Justice Md Rezaul Hasan. Shah Group Chairman KM Mozibul Hoque submitted the complaint on Monday alleging corruption, misconduct and abuse of power.
In the petition, he requested an investigation into the matter and recommended that appropriate action be taken under the Constitution if the allegations are proven.
Supreme Court Registrar General Mohammad Habibur Rahman Siddique confirmed the development to TIMES of Bangladesh on Wednesday. He added that the Supreme Judicial Council has received a complaint against Justice Md Rezaul Hasan.
According to the application, Justice Md Rezaul Hasan displayed biased conduct in two company cases from 2010 and 2011. In one case, the name of a senior lawyer was included in the judgment as having made arguments, despite the lawyer not being present during the proceedings.
The Appellate Division later overturned that judgment.
In another case, the applicant’s wife’s 1.3 million shares were cancelled without making her party to the proceedings, which the applicant stated was entirely contrary to the principles of justice.
The application further alleged that the assets of Justice Md Rezaul Hasan and his close relatives far exceed their declared income, indicating possible corruption.
The applicant claimed that an analysis comparing the family’s movable and immovable assets, vehicles and tax records revealed significant inconsistencies between income and wealth.
The petition also cited several previous disputed incidents involving the judge’s family, which the applicant said raised concerns about his conduct and undermined the image of the judiciary.
One such incident involved the judge’s son crashing a BMW vehicle owned by the family due to reckless driving, followed by alleged pressure on the victim’s family and attempts to prevent any legal action against him, including efforts to stop the media from publishing his name.
Another incident mentioned in the petition involved the judge reportedly refusing to pay toll at a toll plaza while travelling outside official duties, leading to an unpleasant altercation with toll officials, which was reported in major national media outlets.
Justice Md Rezaul Hasan was appointed an additional judge of the High Court Division in June 2009 and was sworn in as a permanent judge on 6 June 2011.
