The Appellate Division of Supreme Court has upheld a High Court order barring authorities from showing former chief justice ABM Khairul Haque arrested or harassing him without a specific case.
A four-member bench of the Appellate Division, headed by the Chief Justice Zubayer Rahman Chowdhury, passed the order on Sunday, disposing of a state petition challenging the High Court order.
As a result, the High Court’s order will remain in force in Khairul Haque’s case, lawyers said.
Lawyers Kamrul Haque Siddiqui, Sara Hossain and Moinam Nabi Shaheen appeared for Khairul Haque, while Deputy Attorney General Mohammad Mehedi Hasan Chowdhury represented the state.
The High Court had issued the order, along with a rule, on 17 May.
ABM Khairul Haque was appointed the country’s 19th chief justice on 27 September, 2010, and assumed office on 30 September that year.
He retired on 17 May, 2011.
After his retirement, he served as chairman of the Law Commission on three occasions.
He resigned from the post on 13 August, 2024, following the fall of the Awami League government.
Police arrested Khairul Haque from his Dhanmondi residence on 24 July, 2025, in connection with a murder case filed with Jatrabari Police Station over the killing of Khobaib.
He has remained in jail since then.
He was later shown arrested in several other cases.
The cases against him include allegations of murder, attempted murder, manipulation of a judgment concerning the caretaker government system and corruption.
