The state has filed an application with the Appellate Division seeking a stay on the bail granted to former Chief Election Commissioner (CEC) Kazi Habibul Awal.
On Monday, Chamber Judge of Appellate Division Justice SM Emdadul Hoque set 26 October for hearing the application.
In the Chamber Court, Advocates SM Shahjahan and Shahdeen Malik appeared on behalf of the petition, whilst Deputy Attorney General Fazlul Karim Mondal represented the state.
Earlier, on 9 September, a High Court bench comprising Justice Md Atowar Rahman and Justice Biswajit Debnath granted bail to Kazi Habibul Awal by allowing a rule issued regarding the matter.
Advocates SM Shahjahan, Sara Hossain, Shahdeen Malik, Md Tayeb-Ul-Islam Showrav and Saikat Bhowmik appeared in court on behalf of the petition, whilst Deputy Attorney General Fazlul Karim Mondal represented the state.
The High Court had previously issued the rule regarding his bail on 28 June.
On 25 June last year, the Detective Branch (DB) of DMP arrested Kazi Habibul Awal from the capital’s Moghbazar area. The following day, 26 June, the court granted a three-day remand for him, and he has been detained in prison since then.
On 22 June of that year, BNP Executive Committee member Salah Uddin Khan filed a case at Sher-e-Bangla Nagar Police Station against election commissions headed by Kazi Rakibuddin Ahmad, KM Nurul Huda and Kazi Habibul Awal, who conducted 10th, 11th and 12th parliamentary elections.
The case was filed on allegations of depriving the public of their voting rights through farcical elections, including night-time voting.
