The hearing of the appeal against the verdict declared by the High Court, which annulled parts of the 15th amendment to the Constitution that brought changes including the abolition of the caretaker government system, has been held.
On Tuesday, 2 December, a six-member bench of the Appellate Division led by Chief Justice Syed Refaat Ahmed accepted the hearing. The hearing has been adjourned until Wednesday.
BNP Secretary General Mirza Fakhrul Islam Alamgir has applied to be a party to this appeal. The court has granted his application. On behalf of the BNP Secretary General, Barrister Ruhul Quddus presented arguments in court.
After the final hearings of two separate writs, the High Court declared parts of the 15th amendment unconstitutional and annulled it on 17 December last year. Against this verdict, four individuals, including the Secretary of Shushashoner Jonno Nagorik (SHUJAN), filed an appeal. Additionally, appeals were filed on behalf of Noagaon resident Md Mofazzal Hossain and Bangladesh Jamaat-e-Islami.
The Awami League government had brought the 15th amendment to the Constitution, introducing changes including the abolition of the caretaker government system. The 15th Amendment Act was passed in the National Parliament on June 30, 2011.
That amendment brought changes to 54 areas of the Constitution, including the abolition of the caretaker government system. After the July mass uprising, two separate writ petitions were filed in the High Court last year challenging the legality of the entire 15th Amendment law and some of its sections.
Five individuals, including SHUJAN, filed one writ petition, and Noagaon resident Md Mofazzal Hossain filed another writ petition. After the hearings, the High Court gave its verdict on 17 December last year.
