A High Court judge has been dismissed from service for his “incapability,” marking one of the rarest instances of a sitting judge’s removal in the nation’s history.
“As per the investigation of the Supreme Judicial Council, Justice Muhammad Khurshid Alam Sarkar of the High Court Division has been found incapable of properly discharging the responsibilities of his position,” reads a gazette notification issued by the Ministry of Law, Justice and Parliamentary Affairs on Wednesday.
The order – which takes immediate effect – states that, in accordance with the provisions of the reinstated Article 96(6) of the Bangladesh Constitution, the president removed him from the said office on 5 November 2025.
The Supreme Judicial Council, chaired by Chief Justice Syed Refaat Ahmed, recommended the removal following an exhaustive inquiry into allegations of misconduct and irregularities during Justice Sarkar’s 12-year tenure.
The 53-year-old judge, appointed as an additional High Court judge in 2011 and confirmed permanently in 2013, was placed on compulsory leave in October 2024, alongside 11 other judges, amid widespread student-led protests demanding judicial reforms.
