Former chief justice ABM Khairul Haque cannot leave the country without permission of the court. This instruction was issued by the Appellate Division while upholding a High Court order that directed authorities not to arrest or harass Khairul without a specific case.
Advocate Motahar Hossain Saju, the counsel for Justice Haque, received a copy of the order on Monday.
This order was passed on 9 August by a four-member bench of the Appellate Division, headed by Chief Justice Zubayer Rahman Chowdhury. According to Advocate Saju, Khairul is now required to seek the court’s permission should he wish to travel abroad.
The legal developments follow a writ petition filed by Khairul’s son, Md Ashik ul Haque, challenging the legality of his father’s arrest.
On 30 March, Khairul was shown arrested in two murder cases filed at Jatrabari and Adabor police stations, shortly after being granted bail in six other cases.
In response to the petition, the High Court issued a rule and directed that the former chief justice should not be arrested or harassed unless there is a specific case against him.
The state subsequently applied to the Appellate Division seeking a stay on this interim order. However, following a hearing on 9 August, the Appellate Division upheld the High Court’s directive.
