The Appellate Division has set 1 February for the hearing of an appeal challenging a High Court order that reinstated the nomination of BNP candidate Sarwar Alamgir in the Chattogram-2 (Fatikchhari) constituency.
Chamber Judge Justice Farah Mahbub fixed the date on Wednesday following a preliminary hearing on the appeal.
Earlier, the High Court stayed an Election Commission (EC) decision that had cancelled Sarwar Alamgir’s candidacy over allegations of loan default and directed the authorities to allow him to contest the election.
The order was issued on 27 January by a High Court bench comprising Justice Fahmida Kader and Justice Md Asif Hassan.
Jamaat-e-Islami candidate Nurul Amin filed the appeal against the High Court ruling with the Appellate Division.
He was represented by Advocate Mohammad Hossain Lipu.
The EC had cancelled Sarwar Alamgir’s nomination on 18 January after an appeal hearing at the Election Commission building, although the returning officer had earlier declared his nomination papers valid.
