The High Court has directed the stripping of the judicial powers of Mamunur Rashid, the then judge of the Feni Women and Children Repression Prevention Tribunal, and ord ered his attachment to the Ministry of Law.
The directive was issued following his indiscriminate sentencing of defendants to death in the sensational murder case of madrasa student Nusrat Jahan Rafi.
A High Court bench comprising Justice Bhishmadev Chakrabortty and Justice KM Rasheduzzaman Raja delivered the order on Monday after concluding the hearing on the death reference, appeals, and jail appeals in the Nusrat murder case.
In its verdict, the High Court observed that the trial court’s indiscriminate capital punishment rulings had brought disaster upon the families of the accused. Consequently, the bench directed that the judicial powers of the then judge Mamunur Rashid be revoked and that he be attached to the Ministry of Law.
Meanwhile, the High Court upheld the death penalty for two convicts in the murder case. They are Siraj Ud-Doula, the then principal of Sonagazi Islamia Fazil (Degree) Madrasa, and Shahadat Hossain Shamim.
Additionally, the High Court acquitted 10 of the accused and sentenced four others to life imprisonment.
Senior Advocate Mansurul Haque Chowdhury, Advocate S M Shahjahan, Advocate Tajul Islam, Barrister S M Masood Hossain Dolon, and Advocate Mohammad Shishir represented the accused in court.
The State was represented by Attorney General Barrister Ruhul Quddus Kajal and Deputy Attorney General Syed Ejaz Kabir.
